Terms and Condition for ad insertions

  1. Credit Approval: All insertion orders are accepted on prepayment basis unless with prior approval by the Publisher.
  2. Prepayment: All prepayments for advertisement whether they are based on (1) contractual or (2) monthly basis, must be made before (1) the first publication date of the contract or (2) the first day of each month during the contract period. All cash and credit prepayments must be received by the publisher the day (before 5:30pm, Monday to Friday ONLY) before the first publication date. Should the check is bounced by the bank, all subsequent insertions shall be canceled with immediate effect and the advertiser is responsible for any bounced check fee incurred by the publisher's bank. Advertisers who are willing to prepay will receive an official receipt when prepayments are made.
  3. Cancellation: All cancellation requests must be in writing and received by the Publisher before booking deadline (7 business days prior to publication). Cancellation after booking deadline is not accepted or the Advertiser is subject to revocation of all discounts given before by the Publisher.
  4. Rights of the Publisher: The Publisher reserves the right to reject any advertisement before publication for whatever reasons as the Publisher sees fits. The Advertiser agrees that the Publisher's decision shall be final and binding, and the Advertiser shall not object to the Publisher's decision.
  5. Rights to Alter the Insertion Date of the Ads: The Publisher reserves the right to alter the date of insertion without prior notice.
  6. The Publisher is not responsible for any damage or loss of the supplied materials by the Advertiser.
  7. The Publisher shall not be responsible for any errors occurred when artwork is supplied by the Advertiser.
  8. The Publisher reserves the right to insert the word "advertisement" on any advertisement copy.
  9. The Publisher only accept the Graphic Material from Advertising Agency.
  10. Ads Agency commission is not applicable to any FD, classified advertisements of Special Package Campaign.
  11. Graphic Design Amendment or Production for Ads Agencies is subject to production time charges depending on service requirements. All amended graphic final proof read has to be done and approved by agency. The Publisher takes no responsibility on any error occur on the amendment.
  12. Preemption: All ads. except full page 4-color ads, are subject to preemption by larger size ads.
  13. Fail to Submit Material on Time: if any advertiser or advertising agency fails to submit material on time, the Publisher reserves the right to repeat a previous advertisement of the correct size or run a house advertisement and the advertiser will be responsible for full payment.
  14. Liability: The Publisher shall not be subject to any liability whatsoever for any failure to publish or circulate all or any part of any issue or issues because of strikes, accidents, fires, Acts of god or any other circumstances not within the control of the Publisher.
  15. Indemnification: Advertisers may be requested to complete, sign, and notarize an indemnification agreement supplied by the Publisher. In any cases, the advertiser shall be liable to the Publisher and indemnify the Publisher against all claims, demands and costs resulting from or arising out of publication of any advertisements on the advertiser's insertion order.
  16. All rates, terms and conditions are subject to change. without prior notice, and should be based on the most updated rate card issued by the Publisher.
  17. The Advertiser must notify the Publisher in writing within three days after the first insertion of an advertisement for any error. make-good insertion will be offered if the error is made by the Publisher. No claims will be entertained after three days.
  18. Prevailing regular rates will apply when the Contract is terminated prior to expiration date.
  19. While every effort will be made to adhere to specified publication date & position, the Publisher reserves the right to make appropriate changes. Missed insertion due to Publisher's negligence will be rescheduled on date agreed upon by the Advertiser.
  20. Advertisement appeared in any of the publications published by the Publisher is deemed to accept the above terms and conditions.
